These Terms & Conditions (“Terms”) apply to all orders and purchases made through the webshop of Zofana, located at Echterstraat 106, 6051 GC, Maasbracht, The Netherlands.

Zofana sells and ships products to customers within the European Union (EU).
By placing an order, the customer agrees to these Terms.
1. Definitions
Webshop / Store: The official Zofana online store, including the website and related services.
Customer: Any natural person or legal entity placing an order via the webshop.
Consumer: A customer acting for purposes outside their trade, business, or profession.
Products: All jewellery items offered via the webshop.
2. Applicability
These Terms apply to all offers, orders, and agreements between Zofana and the customer.
Any deviations are only valid if confirmed in writing by Zofana.
3. Orders & Payment
Orders can only be placed via the webshop.
All prices are stated in euros (€) and include VAT, unless stated otherwise. Shipping costs are displayed separately during checkout.
Payment must be made in advance using the available payment methods.
Zofana reserves the right to refuse or cancel an order in case of suspected fraud, pricing errors, or stock issues.
4. Discounts & Promotions
Discounts, promotional codes, and special offers may be offered from time to time.
They are valid only within the specified period and under the stated conditions.
Discounts cannot be combined unless explicitly stated.
5. Delivery
Zofana aims to dispatch orders within 1-2 business days.
Delivery takes place within the European Union to the address provided by the customer.
Estimated delivery times are indicative and not guaranteed.
Zofana is not liable for delays caused by carriers, customs, force majeure, or other circumstances beyond its control.
Risk Transfer
The risk of loss or damage transfers to the consumer at the moment the product is delivered to the address provided.
6. Right of Withdrawal (Returns)
Consumers within the EU have the legal right to withdraw from their purchase within 14 days after receiving the product, without giving any reason.
After notifying Zofana of the withdrawal, the consumer has an additional 14 days to return the product.
Return shipping costs are the responsibility of the customer, unless the product is defective or incorrectly delivered.
Products must be returned:

Undamaged

In original packaging; jewellery box
Zofana may deduct compensation for diminished value if the product has been used beyond what is necessary to inspect it.
Refunds will be processed within 14 days after receipt of the returned item.
Hygiene Notice
For hygiene reasons, earrings cannot be returned if the hygiene seal has been broken or if they have been worn.
7. Warranty & Manufacturing Defects
Zofana provides a 6-month manufacturing warranty from the date of delivery.
This warranty covers defects in materials or workmanship under normal and intended use.
The warranty applies exclusively to manufacturing defects, including but not limited to:

Stones becoming loose due to defective setting

Faulty clasps or closures

Structural defects in craftsmanship
This warranty does not cover:

Normal wear and tear
-
Scratches, dents, bending, or impact damage

Oxidation, tarnishing, or natural discoloration of sterling silver

Damage caused by water, moisture, sweat, chemicals, perfumes, cosmetics, or cleaning agents

Improper use, storage, or care

Loss or theft
Sterling silver jewellery may naturally oxidize or tarnish over time. This is a normal material characteristic and does not constitute a manufacturing defect.
To submit a warranty claim, the customer must provide:

Valid proof of purchase

Clear photographs

A description of the issue
If approved, Zofana may at its sole discretion:

Replace the item

Offer a replacement of equal value

Provide store credit
-
Issue a refund
This commercial warranty does not affect statutory rights under EU consumer protection law.
8. Product Presentation & Colour Disclaimer
Product images are displayed as accurately as possible.
However, slight variations in colour, size, or appearance may occur due to lighting conditions, screen settings, or manual craftsmanship.
Such minor differences do not constitute a defect.
9. Liability
Zofana is not liable for indirect, incidental, or consequential damages.
If liability is established, it is limited to the purchase price of the product concerned.
This limitation does not apply in cases of intentional misconduct or gross negligence.
10. Intellectual Property
All content on the webshop, including text, images, branding, logos, and product descriptions, is the property of Zofana or its licensors.
Unauthorized use, reproduction, or distribution is strictly prohibited.
11. Privacy
Personal data is processed in accordance with Zofana’s Privacy Policy.
By using the webshop, the customer agrees to the Privacy Policy.
12. Complaints & Disputes
Complaints can be submitted via info@zofana.com.
Zofana aims to respond within 14 days.
Consumers within the EU may also use the European Commission’s Online Dispute Resolution (ODR) platform:

13. Governing Law
All agreements are governed by Dutch law.
Consumers within the European Union may bring disputes before the competent court in their country of residence, in accordance with EU consumer legislation.
